Conditions or Reasons:Prior to the commencement of any works on Kenley House (including demolition) a Schedule of Works shall be submitted to the Local Planning Authority for approval. The information to be provided shall include details of all works to that part of the house that is to be retained, including a schedule of important architectural or historic features to be retained/removed and a means of ensuring their recording and/or preservation, a timetable of works for the various phases of refurbishment and a means of ensuring that appropriate inspections can be carried out by the Local Planning Authority or other interested parties such as local amenity groups throughout the course of the development.Reason: To safeguard the heritage of the Borough by providing an adequate opportunity to investigate and preserve the historic and architectural features of the house before development is carried out, in accordance with Policy UC9 of the Croydon Replacement Unitary Development Plan (The Croydon Plan)
No works on site shall commence until details of the external facing materials have been submitted to and approved by the Local Planning Authority in writing. The development shall only be implemented in accordance with such approved details.
Reason: To ensure that the appearance of the development is satisfactory in accordance with Policy UD3 of the Croydon Replacement Unitary Development Plan (The Croydon Plan)
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any amendment or replacement thereof, planning permission shall be required in respect of development falling within Classes A to H of Part 1 and Class A of Part 2 of Schedule 2 of that Order.
Reason: To ensure that development within the permitted Classes in question is not carried out in such a way as to prejudice or adversely affect the openness or character of the Green Belt and the visual amenity of the area, as required by the policies within the Croydon Replacement Unitary Development Plan (The Croydon Plan).
The development shall be begun within three years of the date of the permission.
Reason: To comply with the provisions of the Town and Country Planning Act 1990 as amended by the Planning and Compulsory Purchase Act 2004
Prior to commencement of any development on site a Landscape Management and Maintenance Plan shall be submitted to the Local Planning Authority for approval. The Plan shall identify existing landscape features within the site and the proposed means for the retention and enhancement of important features both during the construction of the development and following its completion for a minimum period of 5 years from the first occupation of any part of the development. It shall also identify the proposed management regime for the whole of the site, to include areas that will be retained and maintained as woodland areas, meadow areas, or low management areas. The approved management regime for each of these areas shall be implemented as agreed for so long as the development remains in existence, unless otherwise previously agreed in writing with the Local Planning Authority.
Reason: To comply with the Policies of the Croydon Replacement Unitary Development Plan (The Croydon Plan)
Prior to the commencement of the development the approval of the Local Planning Authority shall be obtained with respect to the following matters:-
(1) finished floor levels of the buildings in relation to existing and proposed site levels,
(2) full details of all hardsurfacing within the site, including roads, footpaths and access routes within the site to include materials, levels and gradients,
(3) refuse collection facilities,
(4) all boundary walls and fences or other means of enclosure both on the boundaries of the site or within it,
The approved details for each dwelling shall be implemented as agreed prior to the first occupation of that dwelling.
Reason: To ensure an acceptable standard of development having regard to the policies of the Croydon Replacement Unitary Development Plan (The Croydon Plan)
Prior to the commencement of development (including demolition), a Phasing Programme and Construction Method Statement shall be submitted to the Local Planning Authority for approval. The Programme and Statement shall include the following information for the identified phases of the development and shall be implemented as approved:-
(1) hours of construction,
(2) hours of deliveries,
(4) the size of construction and delivery vehicles,
(5) the vehicular access arrangements to the site from the A22 Godstone Road,
(6) the parking of vehicles associated with deliveries, site personnel, operatives and visitors,
(7) the loading and unloading arrangements for plant and materials,
(8) the siting of any site huts and other temporary structures,
(9) the procedures for the storage and removal of demolition or excavation material (including on-site recycling opportunities), and plant and materials used in the construction of the development.
Reason: To ensure that the development does not prejudice the free flow of pedestrian and vehicular traffic and conditions of safety on the highway or cause inconvenience to other highway users as required by the Policies in the Croydon Replacement Unitary Development Plan (The Croydon Plan).
Prior to the commencement of any development (including demolition) fencing for the protection of those trees and other planting on this site shown to be retained shall be erected in accordance with the Arboricultural Method Statement and Tree Protection Plan prepared by David Brown Landscape Design (dated July 2007). The fencing shall be retained in position until the development is complete and nothing shall be placed within the fencing, nor shall any ground levels within be altered, nor shall any excavation within be made without the prior written consent of the Local Planning Authority.
Reason: To ensure that the trees to be retained are not damaged by the construction and associated works in accordance with Policy UD14 of the Croydon Replacement Unitary Development Plan (The Croydon Plan)
Prior to the commencement of the development, a landscaping scheme to include existing and proposed planting shall be submitted to and approved by the Local Planning Authority; the approved planting shall be provided before any part of the development is occupied or within such longer period or periods as the Local Planning Authority may previously agree in writing and shall be maintained for a period of five years from the date of planting; any planting which dies or is severely damaged or becomes seriously diseased or is removed within that period shall be replaced by planting of similar size and species to that originally provided
Reason: To enhance the appearance of the development, protect the visual amenities of the locality, and to ensure that the new planting becomes established in accordance with Policy UD14 of the Croydon Replacement Unitary Development Plan (The Croydon Plan)
No development including excavations for drainage and foundation work shall take place within the site until the applicant has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted by the applicant and approved by the Local Planning Authority. The development shall only be carried out in accordance with the agreed programme
Reason: The development of this site may damage archaeological remains and this condition is required to safeguard the heritage of the Borough by providing an adequate opportunity to investigate and excavate archaeological remains on the site before development is carried out, in accordance with Policy UC11 of the Croydon Replacement Unitary Development Plan (The Croydon Plan).
No work on site shall take place until a detailed design and method statement for the foundation design and all new ground works has been submitted to and approved in writing by the Local Planning Authority, and the approved details shall be implemented as agreed.
Reason: The development of this site is likely to damage archaeological remains which should ideally be preserved in situ, and this condition is therefore required to safeguard the heritage of the Borough by providing an adequate opportunity to investigate and excavate archaeological remains on the site before development is carried out, in accordance with Policy UC11 of the Croydon Replacement Unitary Development Plan (The Croydon Plan).
(a) maintaining the open character of the Metropolitan Green Belt
(b) maintaining the open character of the area in general
(c) the impact on natural habitats, wildlife and nature conservation
(d) the appearance of the development in the street scene
(e) the relationship of the development to adjacent property
(f) the character of the development in the surrounding area
(g) the impact on the amenities of the occupiers of adjacent and nearby properties
(h) the light and outlook of occupiers of adjacent and nearby properties
(i) the privacy of occupiers of adjacent and nearby properties
(j) the relationship of the development to trees to be retained
(k) the safety of pedestrians and motorists on Kenley Lane and the surrounding road network
(l) the safety and security of buildings and the spaces around them
(m) accessibility to buildings
(n) the housing policies of the development plan
(o) the archaeology policies of the development plan
(p) the impact on the locally listed building
(q) sustainability issues
(r) the recreational open space policies of the development plan
(s) the open land and outdoor recreation policies of the development plan
(t) the urban design policies of the development plan
(u) the environmental protection policies of the development plan
(v) the transport policies of the development plan
The mitigation measures identified in the Further Ecological Surveys Report by LDA Design (4th July 2007) shall be implemented as detailed, unless otherwise previously agreed in writing with the Local Planning Authority.
Reason: In the interests of the preservation and enhancement of natural habitats and wildlife as require by Policies NC1 to NC4 of the Croydon Replacement Unitary Development Plan (The Croydon Plan).
Before the development is begun a report of historical uses of the site shall be carried out to the approval of the Local Planning Authority, to provide an assessment into the possibility of soil contamination.

If the report indicates the possibility of soil contamination an intrusive site investigation and assessment into the possibility of soil, water and gaseous contamination must be carried out to the approval of the Local Planning Authority. The investigation report shall include a risk assessment and details of remediation if required.

Remedial works which are shown to be required must be approved by the Local Planning Authority before any such works are carried out and completed prior to the occupation of any building. A validation report detailing evidence of all remedial work carried out must be submitted to and approved in writing by the Local Planning Authority at the conclusion of the work and before any occupation of the properties.

The developer shall notify the Local Planning Authority of any on site contamination not initially identified by the site investigation so that an officer of the Council may attend the site and agree any appropriate remedial action.

Reason: To ensure the safe development of potentially contaminated land in accordance with Policy EP3 of the Croydon Replacement Unitary Development Plan (The Croydon Plan)
Informative notes:The applicant is advised to consult the Council#s "Code of Practice on the Control of Noise and Pollution from Construction Sites" before commencing work on the site. The Code gives advice on how to undertake work on site in a considerate manner. A copy can be obtained by calling 020 8760 5483.
With respect to the conditions relating to the implementation of a programme of archaeological work and the design and method statement for foundation design and goundworks, the developer is advised to refer to English Heritage's Archaeological Advisor on 0171 973 3732 to discuss the submission of details required to discharge these conditions.
